山東省貫徹落實《關(guan)于加強排污許(xu)可執法監管的(de)(de)指導意見》的(de)(de)若干(gan)措(cuo)施

為(wei)貫徹落實(shi)黨中央、國務(wu)院(yuan)關于深入打好污染防治攻堅戰的決(jue)策部署和省委、省政府要求,扎實(shi)推進(jin)《關于加強排污許可(ke)執法監(jian)管的指導意見》落地落實(shi)落細(xi),制定工作措施如下。

一、主(zhu)要目標

2023年年底,全(quan)省重點行業實施排污(wu)許(xu)可清(qing)單式(shi)執法(fa)(fa)(fa)檢查,排污(wu)許(xu)可日常管理、環境監測、執法(fa)(fa)(fa)監管有效聯動,以排污(wu)許(xu)可制(zhi)(zhi)為核心(xin)的(de)(de)固(gu)定污(wu)染(ran)源(yuan)執法(fa)(fa)(fa)監管體系基本形成。力爭到2024年年底,排污(wu)許(xu)可清(qing)單式(shi)執法(fa)(fa)(fa)檢查實現全(quan)覆蓋,排污(wu)許(xu)可執法(fa)(fa)(fa)監管系統化、科學(xue)化、法(fa)(fa)(fa)治(zhi)化、精(jing)細化、信(xin)息(xi)化水(shui)平顯著提升,以排污(wu)許(xu)可制(zhi)(zhi)為核心(xin)的(de)(de)固(gu)定污(wu)染(ran)源(yuan)執法(fa)(fa)(fa)監管體系全(quan)面建(jian)立。

二、全面落實(shi)責任

(一)壓實(shi)(shi)地(di)方政府屬地(di)責(ze)(ze)任(ren)。各市政府全(quan)(quan)面(mian)負責(ze)(ze)排(pai)污(wu)許可(ke)制度落(luo)(luo)實(shi)(shi),強化統(tong)籌協調,明(ming)確部門職責(ze)(ze)。對(dui)無(wu)法(fa)取得環評批復、影響(xiang)排(pai)污(wu)許可(ke)證核(he)(he)發的(de)歷(li)史遺留問題,全(quan)(quan)面(mian)篩(shai)查形成臺賬,逐一分析研判(pan),做到分類施策、一企(qi)一策。對(dui)具備整改條(tiao)件的(de),應(ying)明(ming)確整改預計期限及路(lu)徑;對(dui)不具備整改條(tiao)件的(de),應(ying)堅決(jue)依法(fa)嚴(yan)肅處理。2023年(nian)年(nian)底前,全(quan)(quan)省固(gu)定污(wu)染源原則上全(quan)(quan)部實(shi)(shi)現持證排(pai)污(wu)。落(luo)(luo)實(shi)(shi)污(wu)染防治攻堅戰(zhan)成效考核(he)(he)對(dui)排(pai)污(wu)許可(ke)管理的(de)考核(he)(he)要(yao)求(qiu),對(dui)排(pai)污(wu)許可(ke)監管工作中的(de)失職瀆(du)職行為依法(fa)依規追究(jiu)責(ze)(ze)任(ren)。(責(ze)(ze)任(ren)單位:各市人(ren)民政府負責(ze)(ze)落(luo)(luo)實(shi)(shi))

(二)強化部(bu)(bu)門(men)監(jian)(jian)管(guan)(guan)責(ze)(ze)任。堅(jian)持(chi)分級管(guan)(guan)理(li),省(sheng)級生(sheng)態(tai)環(huan)境部(bu)(bu)門(men)負責(ze)(ze)全省(sheng)排(pai)污(wu)許(xu)可制度的組織(zhi)實(shi)施和(he)監(jian)(jian)督(du),做好(hao)政(zheng)策(ce)制定、業(ye)務指(zhi)導及監(jian)(jian)督(du)檢查等(deng)工(gong)作;市(shi)級生(sheng)態(tai)環(huan)境部(bu)(bu)門(men)負責(ze)(ze)排(pai)污(wu)許(xu)可證(zheng)(zheng)審批、證(zheng)(zheng)后(hou)管(guan)(guan)理(li)及監(jian)(jian)督(du)檢查等(deng)工(gong)作。優化審批流程,將排(pai)污(wu)許(xu)可證(zheng)(zheng)首次核(he)發(fa)辦理(li)時限壓(ya)減至20個工(gong)作日以(yi)內。加強事中事后(hou)監(jian)(jian)管(guan)(guan),強化證(zheng)(zheng)后(hou)管(guan)(guan)理(li),建立并逐(zhu)步完(wan)善以(yi)排(pai)污(wu)許(xu)可證(zheng)(zheng)為(wei)基礎的全鏈(lian)條“一(yi)(yi)證(zheng)(zheng)式(shi)”環(huan)境監(jian)(jian)管(guan)(guan)體(ti)系。有(you)關(guan)職能部(bu)(bu)門(men)要根據有(you)關(guan)法律法規(gui)和(he)政(zheng)策(ce)文件等(deng)規(gui)定,按照(zhao)管(guan)(guan)發(fa)展(zhan)的、管(guan)(guan)生(sheng)產的、管(guan)(guan)行業(ye)的部(bu)(bu)門(men)必須(xu)按“一(yi)(yi)崗(gang)雙責(ze)(ze)”要求(qiu)抓好(hao)生(sheng)態(tai)環(huan)境保護工(gong)作的總體(ti)要求(qiu),落實(shi)日常(chang)監(jian)(jian)管(guan)(guan)責(ze)(ze)任。(責(ze)(ze)任單位:省(sheng)生(sheng)態(tai)環(huan)境廳牽頭(tou))

三、建立全鏈(lian)條“一證(zheng)式”監(jian)管體系

(四)加強(qiang)排(pai)(pai)(pai)(pai)污(wu)(wu)(wu)(wu)(wu)許(xu)(xu)可(ke)(ke)“全(quan)鏈條”監管銜接(jie)。強(qiang)化排(pai)(pai)(pai)(pai)污(wu)(wu)(wu)(wu)(wu)許(xu)(xu)可(ke)(ke)與(yu)(yu)環(huan)(huan)(huan)(huan)境影(ying)響(xiang)評(ping)價、監測(ce)(ce)、執(zhi)法聯動,完(wan)善信(xin)息共享、線(xian)索移交機(ji)(ji)制(zhi)(zhi)。環(huan)(huan)(huan)(huan)評(ping)審批(pi)部門(men)應在環(huan)(huan)(huan)(huan)評(ping)文件(jian)中(zhong)明確“三(san)線(xian)一單(dan)(dan)(dan)”、規劃環(huan)(huan)(huan)(huan)評(ping)要求(qiu),及建(jian)設單(dan)(dan)(dan)位持證排(pai)(pai)(pai)(pai)污(wu)(wu)(wu)(wu)(wu)、按證排(pai)(pai)(pai)(pai)污(wu)(wu)(wu)(wu)(wu)等責任;排(pai)(pai)(pai)(pai)污(wu)(wu)(wu)(wu)(wu)許(xu)(xu)可(ke)(ke)證核發部門(men)將環(huan)(huan)(huan)(huan)評(ping)文件(jian)中(zhong)污(wu)(wu)(wu)(wu)(wu)染(ran)物排(pai)(pai)(pai)(pai)放(fang)相(xiang)關要求(qiu)依(yi)法納(na)入排(pai)(pai)(pai)(pai)污(wu)(wu)(wu)(wu)(wu)許(xu)(xu)可(ke)(ke)證;監測(ce)(ce)機(ji)(ji)構加大對(dui)排(pai)(pai)(pai)(pai)污(wu)(wu)(wu)(wu)(wu)單(dan)(dan)(dan)位污(wu)(wu)(wu)(wu)(wu)染(ran)物排(pai)(pai)(pai)(pai)放(fang)濃度、排(pai)(pai)(pai)(pai)放(fang)量以及停限(xian)產等特殊時段排(pai)(pai)(pai)(pai)放(fang)情況(kuang)抽測(ce)(ce)力度,及時向執(zhi)法機(ji)(ji)構推送污(wu)(wu)(wu)(wu)(wu)染(ran)物自動監測(ce)(ce)日均(jun)值超標排(pai)(pai)(pai)(pai)放(fang)信(xin)息。加強(qiang)排(pai)(pai)(pai)(pai)污(wu)(wu)(wu)(wu)(wu)許(xu)(xu)可(ke)(ke)制(zhi)(zhi)與(yu)(yu)環(huan)(huan)(huan)(huan)境影(ying)響(xiang)評(ping)價制(zhi)(zhi)度有(you)機(ji)(ji)銜接(jie),探(tan)索實行建(jian)設項目環(huan)(huan)(huan)(huan)評(ping)審批(pi)與(yu)(yu)排(pai)(pai)(pai)(pai)污(wu)(wu)(wu)(wu)(wu)許(xu)(xu)可(ke)(ke)證核發一體(ti)化辦理。(責任單(dan)(dan)(dan)位:省生態環(huan)(huan)(huan)(huan)境廳(ting)牽(qian)頭)

(五)實(shi)施排(pai)(pai)污(wu)(wu)(wu)許可“清(qing)單(dan)(dan)式”執法(fa)檢查(cha)。省級生態環境部門制定排(pai)(pai)污(wu)(wu)(wu)許可清(qing)單(dan)(dan)式執法(fa)檢查(cha)實(shi)施方案,指導各市在(zai)造(zao)紙(zhi)、煉鋼、電力(li)生產(chan)、污(wu)(wu)(wu)水處(chu)理及其再生利(li)用等(deng)重點(dian)行(xing)(xing)業,推(tui)行(xing)(xing)以(yi)排(pai)(pai)污(wu)(wu)(wu)許可證載明事項(xiang)為(wei)重點(dian)的清(qing)單(dan)(dan)式執法(fa)檢查(cha)。將(jiang)排(pai)(pai)污(wu)(wu)(wu)許可落實(shi)情況作為(wei)生態環境執法(fa)監(jian)管必查(cha)內容,加大對(dui)無證排(pai)(pai)污(wu)(wu)(wu)、未按證排(pai)(pai)污(wu)(wu)(wu)等(deng)違法(fa)違規行(xing)(xing)為(wei)查(cha)處(chu)力(li)度。對(dui)偷(tou)排(pai)(pai)偷(tou)放(fang)、自行(xing)(xing)監(jian)測(ce)數據弄虛(xu)作假和不正常運行(xing)(xing)污(wu)(wu)(wu)染防治設施等(deng)惡意(yi)違法(fa)行(xing)(xing)為(wei)依法(fa)嚴懲(cheng)重罰。(責任單(dan)(dan)位:省生態環境廳牽頭)

(六(liu))加強行政(zheng)執(zhi)法與(yu)刑事司法銜接。強化生(sheng)態環(huan)境(jing)、公(gong)安(an)、檢察、審判部(bu)門協作,落實聯(lian)(lian)席(xi)會(hui)議(yi)、聯(lian)(lian)勤聯(lian)(lian)動執(zhi)法、案(an)件(jian)移送、重大(da)案(an)件(jian)會(hui)商督辦、信息通報共享等工作制度,積極開展聯(lian)(lian)合執(zhi)法。探索部(bu)門間優勢互補,提升(sheng)環(huan)境(jing)污染物(wu)證(zheng)鑒定與(yu)評估能力,確保依法、快速、有(you)效懲(cheng)治環(huan)境(jing)犯罪行為。(責(ze)任單(dan)位:省(sheng)生(sheng)態環(huan)境(jing)廳、省(sheng)法院、省(sheng)檢察院、省(sheng)公(gong)安(an)廳按職責(ze)分工負(fu)責(ze))

四、優化執法方式

(七(qi))推(tui)行“雙隨(sui)(sui)機、一(yi)公(gong)開”監(jian)(jian)管(guan)。完(wan)善以排(pai)污(wu)許可發(fa)證登記信息監(jian)(jian)管(guan)數據庫為基(ji)礎的(de)生態環境(jing)“雙隨(sui)(sui)機、一(yi)公(gong)開”監(jian)(jian)管(guan)檢(jian)查對(dui)(dui)象(xiang)庫,并實施動態調整(zheng)。各市(shi)將排(pai)污(wu)許可檢(jian)查納入年度現場檢(jian)查計劃(hua);將存在(zai)生態環境(jing)違法(fa)問題、群眾反映強烈、環境(jing)風險高的(de)排(pai)污(wu)單位列為特殊(shu)監(jian)(jian)管(guan)對(dui)(dui)象(xiang),對(dui)(dui)其增加(jia)抽查頻次。按照“誰(shui)(shui)檢(jian)查、誰(shui)(shui)錄入、誰(shui)(shui)公(gong)開”的(de)原則,及時公(gong)開檢(jian)查結果,主動接受監(jian)(jian)督。(責任(ren)單位:省生態環境(jing)廳牽頭(tou))

(八(ba))構建差異(yi)化(hua)監(jian)管(guan)體(ti)系。按照《山東(dong)省(sheng)企(qi)(qi)業環(huan)境(jing)信(xin)用評價辦(ban)法》,對(dui)企(qi)(qi)業涉及(ji)排污(wu)許可違法行為進行記分(fen),針對(dui)不(bu)(bu)同信(xin)用等級,在財(cai)政性資(zi)金(jin)項(xiang)目支持、評先樹優、執法檢查頻次(ci)等方面(mian)采取差異(yi)化(hua)監(jian)管(guan)措施。實施分(fen)級分(fen)類管(guan)理,健(jian)全(quan)完善企(qi)(qi)業環(huan)境(jing)健(jian)康體(ti)檢打分(fen)體(ti)系,根據低、中(zhong)、高風險等級設置不(bu)(bu)同抽查比例。(責(ze)任單位(wei):省(sheng)生態(tai)環(huan)境(jing)廳、省(sheng)發展(zhan)改革委、省(sheng)工業和信(xin)息化(hua)廳、省(sheng)財(cai)政廳按職責(ze)分(fen)工負(fu)責(ze))構建“自動監(jian)測、用電監(jian)管(guan)+惠企(qi)(qi)服務(wu)線上(shang)整改”為核(he)心的非(fei)現(xian)場執法體(ti)系,大力推行非(fei)現(xian)場執法,2022年(nian)非(fei)現(xian)場執法比例提高10%以上(shang)。加強生態(tai)環(huan)境(jing)監(jian)督執法正面(mian)清單管(guan)理,對(dui)守法排污(wu)單位(wei)減少現(xian)場檢查次(ci)數。(責(ze)任單位(wei):省(sheng)生態(tai)環(huan)境(jing)廳牽頭)

(九)嚴格規(gui)范執(zhi)(zhi)法(fa)(fa)行(xing)(xing)為。落實(shi)行(xing)(xing)政(zheng)執(zhi)(zhi)法(fa)(fa)“三(san)項制度”,綜合運用系統(tong)抽(chou)查、企(qi)業(ye)回訪及(ji)現場(chang)稽查等手(shou)段開(kai)展(zhan)執(zhi)(zhi)法(fa)(fa)稽查,嚴肅查處(chu)環境(jing)監管執(zhi)(zhi)法(fa)(fa)不作為、慢作為、亂作為和選擇性執(zhi)(zhi)法(fa)(fa)、隨意(yi)性執(zhi)(zhi)法(fa)(fa)、情緒性執(zhi)(zhi)法(fa)(fa)等問(wen)題。修訂(ding)完善《山東省(sheng)生(sheng)態(tai)環境(jing)行(xing)(xing)政(zheng)處(chu)罰裁量基準》,明確排污許可(ke)輕微違法(fa)(fa)行(xing)(xing)為不予行(xing)(xing)政(zheng)處(chu)罰具體情形。(責任單位:省(sheng)生(sheng)態(tai)環境(jing)廳牽頭)

五、強化支(zhi)撐(cheng)保障(zhang)

(十)強化(hua)監管(guan)(guan)能力(li)(li)建(jian)設。強化(hua)排污(wu)許可執(zhi)(zhi)法(fa)(fa)(fa)監管(guan)(guan)經(jing)費保(bao)障,各級(ji)要按(an)照(zhao)(zhao)財政事權與支出責任(ren)一致(zhi)的原則,將(jiang)排污(wu)許可執(zhi)(zhi)法(fa)(fa)(fa)監管(guan)(guan)經(jing)費列入本級(ji)預算,強化(hua)執(zhi)(zhi)法(fa)(fa)(fa)裝備和(he)執(zhi)(zhi)法(fa)(fa)(fa)用車保(bao)障。對在生態(tai)環(huan)境執(zhi)(zhi)法(fa)(fa)(fa)辦案中表現突(tu)出的集體和(he)個人(ren)(ren)(ren)按(an)照(zhao)(zhao)有(you)關規定(ding)給(gei)予(yu)通報(bao)表揚或及時(shi)獎勵,調動(dong)環(huan)境執(zhi)(zhi)法(fa)(fa)(fa)人(ren)(ren)(ren)員工(gong)作積極性(xing)。(責任(ren)單位:省(sheng)生態(tai)環(huan)境廳、省(sheng)委組織(zhi)部、省(sheng)財政廳、省(sheng)人(ren)(ren)(ren)力(li)(li)資源社(she)會保(bao)障廳按(an)職責分(fen)工(gong)負責)

(十一)強化(hua)(hua)信(xin)息(xi)化(hua)(hua)建(jian)(jian)設(she)。建(jian)(jian)設(she)完善“山東省排污許可(ke)證綜(zong)合(he)管理(li)系統”,持續(xu)深化(hua)(hua)排污許可(ke)管理(li)數(shu)據(ju)信(xin)息(xi)在環境管理(li)中的(de)應用。推進全員(yuan)、全業(ye)務、全流程(cheng)使(shi)用“山東省生態(tai)環境保(bao)護綜(zong)合(he)執(zhi)法智慧監(jian)管系統”查辦案(an)件,實(shi)現執(zhi)法業(ye)務數(shu)據(ju)全流程(cheng)管理(li)。(責(ze)任單位:省生態(tai)環境廳牽(qian)頭)

(十二)加強普法(fa)宣傳。針對排(pai)污(wu)單位法(fa)人代表、排(pai)污(wu)許可管理人員開(kai)(kai)展專題培(pei)訓。持續開(kai)(kai)展“送法(fa)入企”活動,推行全程說理式執(zhi)法(fa),營造(zao)良好守法(fa)環(huan)境。加強典型案(an)例(li)曝光(guang),曝光(guang)一起、警示(shi)一片(pian),形成(cheng)有效震懾。(責(ze)任單位:省生態環(huan)境廳(ting)、省公安廳(ting)按職(zhi)責(ze)分工負責(ze))
